The administration wants to chill any Trump supporting legal experts so Republicans don’t have legal legs to stand on. The effort is ongoing to prosecute, disbar, and smear Republican leaning attorneys for election 2024. Observers have noted the successful prosecutions of Steve Bannon and Peter Navarro. John Eastman also being targeted. There’s a “bipartisan” effort to hold lawyers accountable.
Lawyers in the cross hairs
The “65 Project” is one of several efforts to “deter future abuse of the legal system by lawyers seeking to overturn legitimate elections”. It’s important to note this effort does not apply to Democrats, only Republicans.
A number of Democrat state officials have tried unsuccessfully to get Trump off the ballot, only to be shot down by the Supreme Court 9-0. As one X/Twitter commenter put it,
“Democrats have aggressively targeted over 400 Republican lawyers and politicians with criminal charges, civil lawsuits, and disbarment proceedings ahead of the upcoming presidential election.
In addition to these criminal trials, Democrats are pursuing numerous efforts to have Republican lawyers disbarred. The Soros-backed 65 Project has filed disbarment proceedings against more than 100 Republican lawyers, which prevent many of these lawyers from working until the proceedings are concluded. In almost every case, the charges lack merit, but they have three primary impacts: a chilling effect that discourages other Republican lawyers and politicians from helping Trump, a financial drain on the resources of Republicans who might otherwise use their funds to help elect Trump, and a time drain that physically keeps them busy during the campaign.
Their goal is to prevent Republicans from ensuring the integrity of the election and protecting the sanctity of your vote.”
Lawyers can’t take it
The efforts are effective. Just days after the 2020 election, Trump’s Pennsylvania lawyers quit. Democrat party activists and lawyers asked firms to take action against any Trump supporting attorneys.
Sanctions are being put up against Rudolph Giuliani, John Eastman, and Kenneth Chesebro. Their law licenses have been suspended.
Ethics experts cheer the movement chasing the fraud. Kathleen Clark is a professor at Washington University in St. Louis School of Law. She said, “If you’re going to rob a bank with a gun, you don’t need a lawyer. But fraudsters often need and often use lawyers to commit their fraud.”
Election lawyers getting shut up
The disciplinary actions have no precedent. The legal profession is sorting out the cases even as the next election comes up.
Legal ethics are being tried and according to Clark and Richard Painter, a University of Minnesota Law School professor, they’re not fast enough. Painter sees democracy in trouble. “These lawyers’ actions have brought discredit to the bar, and the bar has a role in reining that in. There’s a great concern that our democracy was in peril and that these lawyers went way overboard.”
Clark said, “The fact that it’s taken four years suggests current structures are not up to the task.” Jim Robenalt is a Thompson Hine partner who teaches legal courses with Watergate whistleblower John Dean. He said that “there is no question that the 2020 election woke up the bar associations in some places.”
