An update on a New Jersey gym owner’s lasting battle against COVID tyranny included a special message for Garden State Gov. Phil Murphy (D).
Cafes, bars and restaurants alike were all among the small businesses deemed non-essential by local, state and federal authorities in arguably the most devastating instance of government overreach America had ever seen. Despite the overwhelming pressures and collective forces opposing common sense and freedom in 2020, some, like Ian Smith, owner of Atilis Gym in Bellmawr, New Jersey, refused to buckle, even as the draconian orders were coupled with fines and charges.
Having held his ground and kept up the fight, Smith announced a “major victory” in the courts with a lasting impact on the state.
He reminded that “4 years ago today, we reopened Atilis Gym in direct violation of an unconstitutional order by Governor Phil Murphy to close small businesses in New Jersey. The support we received locally, nationally, and internationally for our stand is something I will be forever grateful for.”
“With that being said, I am thrilled to announce that we have achieved a major victory in the long, hard fight against the State,” the gym owner added.
“ALL OF THE 80+ municipal citations of violations of a governor’s order, public nuisance, disturbing the peace, and operating without a license against us have been dropped by the courts WITH prejudice,” declared Smith. “This means the State has NO ability to [revisit] or refile these charges.”
“This victory opens the battlefield again and gives us options to continue to push back and bring justice to the treasonous actions of Phil Murphy and his lackies,” he added.

After a nod to supporters and “fearless attorneys” John McCann and Giancarlo Ghione, who “stood with us through the darkest days of the storm,” Smith promised there would be more updates to come before signing off with a special note for the governor.
“Suck my d*** Phil Murphy.”
As it happened, in Jan. 2021, less than a year into the gym’s fight against the state’s lockdowns, the business owner who would go on to launch a failed bid for Congress had announced that the governor “and his cronies” had seized the money from their legal defense fund amounting to more than $170,000, “intentionally interfering with our right to council.”
The lasting case that included him and co-owner Frank Trumbetti had found them quickly facing $1.2 million in fines and a sentence in 2022 to one-year probation.
The victory for the New Jersey gym happened to come days after the January closed-door testimony of former National Institutes of Health Director Francis Collins to the House Select Subcommittee on the Coronavirus Pandemic was publicly released.
Within the nearly 250-page transcript, Collins had admitted that not once by the time of his testimony had ever seen scientific evidence that supported the Centers for Disease Control guidance promoting six-feet social distancing.
