Arizona prosecutors announced Monday that they will not seek a retrial in the case of a rancher who fatally shot a Mexican national on his property near the Mexico border.
The prosecutors made their decision after a judge last week declared a mistrial in the case because of a locked jury.
The mistrial was declared against George Alan Kelly  after the jury failed to secure an unanimous verdict on whether he was responsible for the death of Gabriel Cuen-Baltimea, who was found fatally shot on Kelly’s ranch near the southern U.S. border on Jan. 30, 2023. Kelly had been accused of second-degree murder.
