The only surviving son of jailed murderer and fraudster Alex Murdaugh plans to sue Netflix and Warner Brothers over documentaries that link him to the murder of his former classmate.
Buster Murdaugh, 30, is suing several media outlets and two major studios for damaging his reputation.
ABC reported he seeks actual and punitive damages due to the “reckless conduct of the defendants in falsely accusing him of being involved in the murder of Stephen Smith.”
He’s asserting that various films and stories about the case have connected him to the killing of 19-year-old Stephen Smith, Daily Mail reported.
Smith, who was openly gay, was found dead on a road near the Murdaugh estate in South Carolina, with police initially ruling his death a hit-and-run.
Authorities reopened Smith’s case in June 2021 following the surge of interest in the Murdaugh case and rumors of a sexual relationship between Smith and Buster
Officials declared Smith’s death a homicide, prompting his mother Sandy to launch a GoFundMe campaign to fund the exhumation of his body.
Buster denounced any reports linking him to Smith’s death as “vicious rumors” last year, despite the lawsuit asserting there are no formal allegations against him.
The suit cites films about the Murdaugh murders from Netflix, Warner Bros and Discovery+, in addition to Gannett publishing.
“The false statements were published to hundreds of thousands, if not millions, of viewers who watched the show,” it read.
Buster is suing a local newspaper too for also allegedly linking him to Smith’s death.
Eric Bland, an attorney for Smith’s family, has warned that Buster attempting to suppress information will only backfire and expose him further.
“I think the defendants will love this lawsuit because it will make a part three of any documentary,” he told The Daily Beast.
“Buster was never asked if he had any knowledge of [Smith’s] death. He just said he didn’t kill [Smith] and didn’t have a sexual relationship with him.”
“I think this lawsuit will backfire,” he continued after stating he was “very interested” in what new information might be revealed as a result of Buster “exposing himself.”
“I talked to a number of attorneys who were asked to take on his lawsuit and they passed. This will only bring a spotlight to Stephen’s investigation.”
Buster’s father Alex Murdaugh is now in prison for the murders of his wife, Maggie, 52, and his youngest son, Paul, 22, as outlined by Daily Mail
He’s also in jail for numerous financial crimes and will have to pay nearly $9 million in restitution.
Murdaugh killed his wife and son, hoping to evoke sympathy and divert attention from the missing money, investigators revealed back in June of 2021.
Paul Murdaugh was shot multiple times with a shotgun and Maggie Murdaugh was shot several times with a rifle outside the family’s home in Colleton County.
Alex has maintained his denial of killing them both.
