Ohio Secretary of State Frank LaRose determined that Joe Biden accepting the Democrat nomination for president at their convention in Chicago this summer could cost Biden ballot access because of the schedule.
The Democratic National Convention is set to begin on August 19 and Ohio’s deadline to certify a presidential candidate is August 7.
“The Democratic National Convention is scheduled to convene on Aug. 19, which will take place more than a week after the Aug. 7 deadline to certify a presidential candidate in Ohio, the office flagged according to state code, which would create a problem for Biden’s eligibility,” ABC News reported.
LaRose’s legal counsel Paul DiSantis wrote to state Democrat Party Chairwoman Liz Walters on the dilemma Biden faces due to the national party being asleep at the wheel in monitoring state ballot access laws.
“I am left to conclude that the Democratic National Committee must either move up its nominating convention or the Ohio General Assembly must act by May 9, 2024 (90 days prior to a new law’s effective date) to create an exception to this statutory requirement,” DiSantis’ letter to Walters read.
The Biden campaign responded, saying it is monitoring the situation and is confident Biden would appear on the ballot.
However, the statement didn’t include any specifics about how the campaign or the Democrat Party planned to address the conflict between Ohio ballot access laws and the scheduled date for the party’s national convention.
“We’re monitoring the situation in Ohio and we’re confident that Joe Biden will be on the ballot in all 50 states,” a Biden campaign statement to ABC News read.
Biden not appearing on the Ohio ballot would be a disaster for Democrats.
But just not for the reason everyone thinks.
Ohio used to be the consummate swing state.
From 1964 to 2016, Ohio voted for the winner in every presidential election and the margin in Ohio often matched the national popular vote margin.
But starting in 2016, Donald Trump turned the state crimson red.
In 2016 and 2020 Trump carried Ohio by eight points.
Trump is expected to win Ohio in a landslide again in November.
And if Biden’s name isn’t on the ballot, irregular Democrat Party voters likely won’t show up.
That could doom Democrat incumbent Senator Sherrod Brown who’s trying to fend off a challenge from Trump-endorsed Bernie Moreno in his quest for a fourth term.
The Real Clear Politics polling average shows Brown already in the danger zone with 42 percent of the vote against Moreno.
If base Democrat Party turnout can’t match the GOP’s because Trump is on the ballot and Biden isn’t, that could doom Brown to defeat.
Republicans only need to win two Democrat-held seats to flip the majority in the Senate.
The GOP is a heavy favorite to flip retiring Senator Joe Manchin’s seat in ruby-red West Virginia.
Biden not being on the ballot, depressing Democrat turnout in Ohio, won’t just cost Democrats Ohio’s Electoral College votes, it could also cost Democrats the majority in the U.S. Senate.
