New York Supreme Court Justice Juan Merchan allegedly permitted a juror who publicly rejoiced over former President Donald Trump’s defeat in the 2020 election on social media to continue serving in the jury pool.
The trial of Trump, which is considered unprecedented, commenced on Monday morning with the selection of jurors, marking the initial phase of a process that may extend over a period of two weeks. The trial is anticipated to conclude by June. In the course of Tuesday’s jury selection, Trump’s defense lawyers sought to disqualify a potential juror from participating in the case due to her expression of joy over Trump’s loss in the 2020 election, as reported by Fox News.
“They wanted to have a peremptory challenge to excuse the juror because they thought that she said she could be impartial, but had social media posts that apparently had her celebrating Trump’s loss in 2020,” Trace Gallagher reported, “and so they challenged her. The judge said, ‘Nope, she can be impartial. She stays.’”

According to courtroom journalists, out of the initial pool of 96 potential jurors, 34 individuals are still in consideration for Trump’s criminal trial. On Tuesday, these remaining potential jurors moved forward to the next phase, where they were required to complete a questionnaire. This questionnaire aims to gather information about their media consumption, place of residence, and political activities.
Following the completion of the questionnaire, lawyers representing both sides will carefully examine the potential candidates. It is expected that the lawyers will delve into the jurors’ social media presence and pose additional personal inquiries in order to identify any potential biases.
