On Friday, the Department of Justice recommended a 40-year sentence on Friday for David DePape, who broke into the home of former House Speaker Nancy Pelosi, and attacked her husband Paul in 2022.
In November 2023, DePape was found guilty on all federal charges after breaking into the home in an attempt to kidnap the former speaker. When he discovered that she was not there, he held Paul Pelosi hostage and eventually bludgeoned him over the head with a hammer.
In the DOJ memo, prosecutors wrote that “sentencing factors compel the statutory maximums recommended here.”
“The defendant planned a violent hostage-taking of the Speaker Emerita, and then nearly killed her husband,” prosecutors wrote. “The defendant planned and unleashed violence and has stayed true to his belief that his actions were necessary.”
Additionally, U.S. attorney Ismail Ramsey, along with assistant U.S. attorneys Helen Gilbert and Laura Horn, argued that the sentencing factors “demonstrate that the 30 years maximum on the count with the most significant statutory maximum is not sufficient to meet the sentencing goals.”
Although DePape pleaded not guilty to the charges against him, he testified that he did attack Paul while attempting to kidnap his wife. Pelosi was hospitalized for six days due to a skull fracture and other injuries.
“The door opened and a very large man came in with a hammer in one hand and some ties in the other and he said, ‘Where’s Nancy‘ as I think that woke me up,” Pelosi testified during the trial. “I’m asleep and he bursts in the door and that woke me up.”
“It was a tremendous shock to recognize that somebody had broken into the house and looking at him and looking at the hammer and the ties, I recognized that I was in serious danger, so I tried to stay as calm as possible,” he said.
DePape also listed other targets that he had intended to pursue during his testimony, including Tom Hanks, Hunter Biden, former Vice President Mike Pence, Democratic California Gov. Gavin Newsom and independent Vermont Sen. Bernie Sanders.
DePape’s defense attempted to blame conspiracy theories and his delusional views about politicians and government.
DePape claimed he was influenced by “right-wing” podcasts and YouTube channels, and said he was “often listening to them for hours” before the attack.
“At that time I was biased against [former President Donald] Trump, but there’s, like, truth there,” he said through tears. “So, if there’s truth out there that I don’t know, I want to know it.”
