A report from NBC News alleges that Hunter Biden intends to sue Fox News “imminently.”
The letter was sent to Fox News on April 23, stating that the coming litigation stems from Fox’s “conspiracy and subsequent actions to defame Mr. Biden and paint him in a false light, the unlicensed commercial exploitation of his image, name, and likeness, and the unlawful publication of hacked intimate images of him.”
According to NBC, Biden has hired attorney Mark Geragos to represent him in the coming lawsuit, and this is the second time that Biden’s team has reached out to Fox this month. A source alleged that Fox’s counsel was given a letter two weeks ago, and the network asked for more time to respond.
The latest letter included a response deadline of April 26, and is signed by Tina Glandian, a partner at Geragos & Geragos.
Biden has reportedly planned legal action against the outlet for over a year. This new suit was reportedly inspired by the success of the lawsuit brought by Dominion Voting Systems. Fox News alleged that Dominion aided in election fraud in the 2020 election. Fox is currently facing a $2.7 billion lawsuit brought by Smartmatic, another voting system company that was covered by the network in their claims.
Biden’s lawsuit largely circles around the fact that bribery allegations which were aired by Fox multiple times originated from FBI informant Alexander Smirnov, who was indicted by special counsel David Weiss in February. The suit alleges that Fox knew that the bribery allegations were unverified at the time but continued to report that the source was “highly credible.”
The suit demands that television hosts “including Sean Hannity, Jesse Watters, and Maria Bartiromo, to inform their viewers on air that they have been sharing a debunked allegation from a source who has been federally indicted.”
“For the last five years, Fox News has relentlessly attacked Hunter Biden and made him a caricature in order to boost ratings and for its financial gain. The recent indictment of FBI informant Smirnov has exposed the conspiracy of disinformation that has been fueled by Fox, enabled by their paid agents and monetized by the Fox enterprise. We plan on holding them accountable,” Geragos said in a statement.
Additionally, the letter focuses on the airing of “intimate images” that stemmed from Biden, specifically his infamous laptop, which his lawyers say were “hacked, stolen, and/or manipulated.” They argue that the airing of those images violates Biden’s civil rights as well as copyright law.
Additionally, the letter discusses “The Trial of Hunter Biden” series, which aired in October 2021, which Fox claimed was what a trial could look like if Biden were to be charged with Foreign Agents Registration Act or bribery charges.
“While using certain true information, the series intentionally manipulates the facts, distorts the truth, narrates happenings out of context, and invents dialogue intended to entertain. Thus, the viewer of the series cannot decipher what is fact and what is fiction,” the letter says. “We hereby demand that FOX expeditiously remove and disable access to any and all intimate images of Mr. Biden from ‘The Trial of Hunter Biden.’”
The suit comes as Biden prepares for several criminal trials, with his trial on gun charges starting June 3, and his tax case expected to be tried in August. He has pleaded not guilty in both cases.
Fox News has not yet responded to the letter.
