Just as Fulton County District Attorney Fani Willis thought she could start her retaliation campaign against President Donald Trump, the former president scored another victory against her as the Georgia Court of Appeals agreed to hear his appeal case.
Fulton County District Judge Scott McAfee ruled that Willis, who was involved in a courtroom tryst against Special Prosecutor Nathan Wade, could continue her election interference case against Trump last March.
Judge McAfee ruled that Willis could pursue her case if her lover and special prosecutor, Nathan Wade, withdrew from the case after receiving more than $650,000 from the government.
The two claimed that their relationship only began during the prosecution of Trump. However, witnesses attest that their affair started in 2019 or 2020. Defendants also questioned the hundreds of thousands the couple spent on luxury trips together. Wilis stressed that she reimbursed Wade for the costs incurred on their vacations but failed to show proof of reimbursement.
The Court of Appeals of the State of Georgia gave a green light for the appeal on Wednesday. This move would likely delay the trial for the election interference case against the former president and several co-defendants.
“Upon consideration of the Application for Interlocutory Appeal, it is ordered that it be hereby granted. The Appellant may file a Notice of Appeal within 10 days of the date of this order. The Clerk of Superior Court is directed to include a copy of this order in the record transmitted to the Court of Appeals,” the state appeals court ordered.
Trump’s lawyer, Steve Saddow, wrote on X, “The GA Court of Appeals has granted President Trump’s Application for Interlocutory Appeal from the trial court’s order refusing to disqualify Fulton County DA Fani Willis!!!”
“President Trump looks forward to presenting interlocutory arguments to the Georgia Court of Appeals as to why the case should be dismissed and Fulton County DA Willis should be disqualified for her misconduct in this unjustified, unwarranted political persecution,” Sadow further remarked in a statement.
Trump’s legal team would prove to the appeals court that Willis and Wade’s relationship equates to a conflict of interest, aside from the questionable handling of the state’s finances.
McAfee, last March, remarked that the pretrial hearing in his court would not be affected if the appeals court reconsiders his decision. However, defendants could seek a stay from the appeals court, which could stall the RICO charges against Trump.
