The Trump administration and D.C. District Judge James Boasberg have been butting heads since March, when the judge attempted to hold the administration in contempt for allegedly violating an unwritten oral order he’d issued in a case involving the deportation of criminal illegal aliens to El Salvador.
On Monday, the Justice Department took the rare but significant step of filing a formal misconduct complaint against Boasberg, CNN reported.
The complaint, which calls for a special investigation, the reassignment of cases, and the possible impeachment and removal of the judge, stems from “improper public comments” he made about President Donald Trump and the administration at a Judicial Conference in March.
Formal misconduct complaint filed
In an X post on Monday, Attorney General Pam Bondi wrote, “Today at my direction, @TheJusticeDept filed a misconduct complaint against U.S. District Court Chief Judge James Boasberg for making improper public comments about President Trump and his Administration.”
“These comments have undermined the integrity of the judiciary, and we will not stand for that,” she added.
CNN obtained a copy of the complaint written by Bondi’s chief of staff, Chad Mizelle, which asserted that the Obama-appointed Boasberg “undermined the integrity and impartiality of the judiciary” while at a Judicial Conference meeting in March in Washington D.C.
“While there, Judge Boasberg attempted to improperly influence Chief Justice (John) Roberts and roughly two dozen other federal judges by straying from the traditional topics to express his belief that the Trump Administration would ‘disregard rulings of federal courts’ and trigger ‘a constitutional crisis,” he continued. “Although his comments would be inappropriate even if they had some basis, they were even worse because Judge Boasberg had no basis.”
Then, just days later, the judge “began acting on his preconceived belief that the Trump Administration would not follow court orders” by way of his allegation that the administration had violated a supposed oral order he’d delivered but never officially set down in writing.
Judicial Conference memo exposed Boasberg’s pre-existing anti-Trump bias
The formal complaint against Judge Boasberg appears to have been spurred, at least in part, by a damning report from The Federalist about two weeks earlier that exclusively exposed an internal memo from the Judicial Conference in D.C. that was held during the week of March 11, 2025, and in which Boasberg was a participant.
During a “working breakfast,” according to the memo, the D.C. district judge “raised his colleagues’ concerns that the Administration would disregard rulings of federal courts, leading to a constitutional crisis.”
“Chief Justice Roberts expressed hope that would not happen, and in turn, no constitutional crisis would materialize,” the memo continued, and further noted that Roberts countered Boasberg by noting that every interaction he’d had with President Trump had been “civil and respectful.”
The article noted that just a few days after Boasberg shared his belief that Trump would ignore or violate court orders, he accused the administration of having “committed criminal contempt of court” for failing to abide by his alleged unwritten order to turn around aircraft in mid-flight that were transporting deported criminal illegal aliens and gang members to be imprisoned in El Salvador.
Complaint urges an investigation and disciplinary actions
According to CNN, the DOJ’s formal complaint against Judge Boasberg calls upon the chief district judge in D.C., Sri Srinivasan, to forward the complaint to a special investigative committee, reassign Boasberg’s Trump-related cases to other judges, and “impose appropriate disciplinary action, including a public reprimand and referral to the Judicial Conference for consideration of impeachment-related recommendations, if the committee finds willful misconduct.”
The outlet noted that Boasberg is now the second federal judge that the Trump DOJ has filed a formal misconduct complaint against, as a similar accusation was lodged against D.C. District Judge Ana Reyes in February over improper comments and actions she made while presiding over a case involving the president’s executive order to ban transgender troops from serving in the U.S. military.
