Flanked by the head of Homeland Security, Kristi Noem, and border czar Tom Homan, President Trump says he will pour ICE agents into sanctuary cities after the shooting of a Customs and Border Protection agent in New York City.
The President said he’s fed up with the city’s sanctuary laws and will now “flood” the area with Immigration and Customs Enforcement agents to arrest people wherever they find them.
The horrific shooting – by an illegal with a long criminal record – unfolded at 11:51 p.m. Saturday, July 19, in Fort Washington Park in the Washington Heights neighborhood of upper Manhattan, according to the New York Police Department.
Video of the incident released by the Department of Homeland Security shows two men approach the 42-year-old officer on a moped, with a female companion pulling out a gun.
“The officer realized that he was being robbed and drew his service weapon in defense,” said New York City Police Commissioner Jessica Tisch.
The officer, who was shot in the face and arm just before midnight on Saturday, remained hospitalized and is expected to survive after exchanging gunfire with an undocumented migrant with a lengthy criminal record and outstanding arrest warrants.
The suspected gunman, 21-year-old Miguel Francisco Mora Nunez, an undocumented migrant from the Dominican Republic, was also shot in the incident and detained after he went to an area hospital for medical treatment.
The second migrant criminal involved in the attempted robbery, Christhian Aybar-Berroa, 22, was nabbed by ICE agents Monday following the arrest of Nunez.
Nunez is accused of shooting the 42-year-old officer while Aybar-Berroa allegedly helped with the robbery, officials said.
“It’s a case that we will continue to work — that he was a part of this robbery on Saturday night — and hopefully he will face consequences for being a part of that,” said Homeland Security Secretary Kristi Noem during a fiery news conference at Harlem Hospital.
A witness of the attack stated that she and the victim were “sitting on the rocks by the water when two subjects on a scooter drove up to them, dismounted the scooter, and approached them with a firearm drawn. The off-duty CBP officer responded by withdrawing his own firearm in self-defense. The CBP officer was shot in his right arm and left cheek. Thankfully, the officer is in stable condition at the hospital, Homeland Security said.
Tom Homan said he’s especially angry with the City Council and that he is no longer going to play nice with the mayor, or hope he can convince the City Council or the courts to let ICE agents operate on Rikers Island.
“Sanctuary cities get exactly what they don’t want — more agents in the community and more agents in the worksite. If we can’t arrest that bad guy in the safety and security of county jail, we’ll arrest him in the community,” Homan said, “and when we arrest him in the community, if he’s with others that are in the country illegally, they’re coming, too.”
Lengthy Criminal Records
Both of the suspects have extensive criminal records, including violent offences.
Aybar Berroa “illegally entered the United States on June 19, 2022, and was released into the country on interim parole pending his immigration hearing,” according to the Department of Homeland Security.
He then allegedly committed a litany of crimes in New York City, including arrests for 2nd degree reckless endangerment in May 2023 and 4th degree felony grand larceny and petit larceny in March and April 2024, officials said.
“On June 12, 2025, Berroa pled guilty to petit larceny at the Bronx County Supreme Court. This plea was made in consolidation of all his previous arrests, and he was conditionally discharged and allowed to roam the streets of NYC,” it also said. “A judge ordered Berroa a final order of removal on January 3, 2023.”
Nunez was arrested eight times between March and April 2024 for grand larcenies. He’s also a suspect in at least four additional cases.
The pair is now expected to face federal charges in connection with the shooting.
