
A drag performance scheduled for this weekend’s Pride festival in Naples will be moved indoors, after a federal appeals court on Friday reversed an earlier ruling that had cleared the way for the show to be held outside.
The decision from a panel of the U.S. Court of Appeals for the Eleventh Circuit came one day before the eighth annual Naples Pride Fest, forcing organizers to relocate the drag show to the Norris Center, near Cambier Park.
According to court documents, the appeals panel stayed a district judge’s ruling that had blocked the city’s conditions requiring the drag show to be held indoors and limited to people 18 and older.
The city had argued the restrictions were necessary for safety reasons and not based on the content of the performance.
The panel’s majority agreed, citing public interest and potential safety concerns. A dissenting judge criticized the decision, saying it infringed on Naples Pride’s First Amendment rights.
