A major win for Planned Parenthood — and a big setback for Republicans’ efforts to cut off taxpayer funds to the nation’s largest abortion provider.
On Monday, U.S. District Judge Indira Talwani, an Obama appointee, issued a sweeping preliminary injunction blocking a key provision of the “Big, Beautiful Bill” that would have stripped Planned Parenthood of Medicaid funding for one year. The judge expanded on an earlier, narrower ruling that had only protected a subset of Planned Parenthood affiliates, effectively mandating that Medicaid reimbursements continue to flow to all Planned Parenthood clinics while the lawsuit moves forward.

Talwani argued that patients could face “adverse health consequences” if Planned Parenthood lost funding, citing risks of “increased unintended pregnancies,” “attendant complications,” and more undiagnosed STIs due to reduced access to contraceptives and other services. In her order, she emphasized that the court was not directing the federal government to fund elective abortions but rather blocking what she described as a “targeted exclusion” of Planned Parenthood from Medicaid reimbursements — a move she suggested likely violates the U.S. Constitution.
The lawsuit alleges Congress singled out Planned Parenthood through the defunding provision, despite the bill not naming the organization explicitly. Planned Parenthood argued that cutting its Medicaid funds would have “devastating effects,” potentially forcing nearly 200 clinics to shut their doors.

The Department of Health and Human Services (HHS), defending the provision, countered that Planned Parenthood has “no right to taxpayer money” and urged the court to uphold Congress’s authority to determine funding priorities. “States should not be forced to fund organizations that have chosen political advocacy over patient care,” said Andrew Nixon, HHS communications director.
The fight comes as Planned Parenthood boasts record numbers in its latest annual report: 402,230 abortions in 2023-2024 — a nearly 10,000 increase over the previous year — and $792.2 million in taxpayer funding, almost $100 million more than the prior year.

Pro-life advocates blasted the injunction, noting that even with the Hyde Amendment’s restrictions on direct abortion funding, federal money still subsidizes an organization responsible for over 400,000 abortions last year.
The ruling also comes just weeks after the Supreme Court sided with South Carolina in a separate case, affirming the state’s right to block Planned Parenthood from Medicaid funding — a decision that could ultimately shape the trajectory of this federal case as it moves through the courts.
