The Brooklyn straphanger who shot a berserk rider attacking him on a rush-hour train Thursday will not be charged, prosecutors said Friday.
“Yesterday’s shooting inside a crowded subway car was shocking and deeply upsetting,’’ Oren Yaniv, a spokesman for the Brooklyn District Attorney’s Office, said in an emailed statement.
“The investigation into this tragic incident is ongoing but, at this stage, evidence of self-defense precludes us from filing any criminal charges against the shooter.”
The 36-year-old man who went berserk and started the fight on the train has now been identified as Dajuan Robinson.
The 32-year-old man who Johnson attacked, and who ultimately took the gun away from Johnson and shot him in the head with it, has been identified as Younece Obuad.
Based on multiple reports, it appears Robinson may have lost it over seeing Obuad on the train and assuming he was an illegal alien.
“F**k your kind. F**k your race. F**k you,” Robinson yelled at Obuad. “You think you’re gonna beat up cops? I’ll beat you up!”
His remarks appear to be in reference to an incident in January, when a mob of illegal aliens attacked NYPD officers.
Officials say Johnson is hospitalized in critical condition, and are uncertain whether he will survive.
While agreeing with the “self-defense” decision, many people on social media are drawing a comparison to Daniel Penny, a former U.S. Marine who has been charged with manslaughter after he took down a belligerent man, Jordan Neely, who was threatening others on a subway train. Penny put Neely, a 30-year-old Black man, in a chokehold, which resulted in his accidental death. That incident happened in May of last year.

Rep. Nicole Malliotakis (R-N.Y.) shared a video clip captured by ABC’s Joyce Phillippe, who was one of the passengers on the subway, and wrote: “Yesterday’s subway shooting in #Brooklyn & cries from bystanders for the NYPD should be a wake up call to New York’s left wing leaders that we need adequate policing levels in our subways & on our streets, as well as laws that keep criminals OFF our streets. We need to prioritize spending on the needs of citizens, not illegal immigrants. We need laws that protect the law-abiding, not the law-breaking. We need safe subways, not congestion pricing.”
