We have reported prior on liberal pundits demanding that Sotomayor retire so Joe Biden can appoint her replacement.
That movement just got a bit stronger.
The Atlantic is now among those liberal outlets that believe the oldest liberal justice needs to step down before it’s too late.
Time to Go
At 69 years old, Justice Sotomayor is the oldest of the liberal justices on the bench.
If Biden loses this election, Democrats are worried that it could be almost a decade before the Democrats get the White House again.
So, they are now pressuring Sotomayor to retire to ensure another liberal grabs that seat.
It would be a complete and utter disaster if something happens and her seat becomes vacant, as it would hand the conservatives a 7-2 edge on the court.
I fully suspect that if Trump wins this election, Justices Roberts, Alito, and Thomas could possibly retire before the end of his term.
If you add Sotomayor to that list, Trump would have the chance to appoint every conservative justice on the court.
To that point, The Atlantic published a piece titled “Sonia Sotomayor Should Retire Now,” explaining why Sotomayor needs to retire immediately.
The one thing that Democrats do not have to worry about time around is Senator McConnell (R-KY) blocking Biden’s appointment, as he did during the waning days of the Obama administration.
With Senator Schumer (D-N.Y.) now calling the shots in the Senate, there is no doubt that a Biden appointment would be pushed through with the speed that McConnell did with Trump’s final appointment, Justice Amy Coney Barrett.
For her part, Sotomayor has not even shown an inkling that she is ready to step down just yet.
While she has expressed concerns about the criticism of the court, also noting that this is all quite mentally taxing right now, she still insists her job is not quite done on the court just yet.
At this point, I think it is highly unlikely that she buckles to pressure, but you just never know in this day and age.
The more publications that jump on this wagon, the more pressure there will be for her to step down, so this is now a battle of wills over the next eight months to see if they can get her to buckle and walk away from her seat.
