Democrats are accelerating their lawfare against Donald Trump.
It’s all part of their 2024 election strategy.
And Jack Smith raised hell when he suffered one setback in his Trump witch hunt.
Special Counsel Jack Smith is attempting to send Donald Trump down the river in two different cases.
Smith is handling the January 6 case as well as the classified documents case in Florida, but the documents case is looking like more of a loser for the Democrats.
Biden ruined the game
The teeth were taken out of that case when Joe Biden got popped for the exact same classified documents violation.
Biden got less than a slap on the wrist for knowingly possessing classified documents, so the optics of throwing Trump in jail for the same offense would be terrible.
Nevertheless, Smith is going to war with the judge in the documents case.
Smith argued in a court filing that Judge Aileen Cannon’s jury instructions were based on a “fundamentally flawed legal premise.”
Trump’s defense is that he had authority under the Presidential Records Act (PRA) to declassify anything he wanted and keep it in his home.
Smith claimed that the PRA was not relevant to the case.
He wrote, “That legal premise is wrong, and a jury instruction for Section 793 that reflects that premise would distort the trial. . .The PRA’s distinction between personal and presidential records has no bearing on whether a former president’s possession of documents containing national defense information is authorized under the Espionage Act, and the PRA should play no role in the jury instructions on the elements of Section 793.”
In other words, Smith wants the case framed based on his theory.
Clock is ticking
Either way, the classified documents case is not moving at the pace that the Democrats want.
The same goes for the January 6 case.
Smith added, “Whatever the court decides, it must resolve these crucial threshold legal questions promptly. . .The failure to do so would improperly jeopardize the government’s right to a fair trial and deprive it of its right to seek appellate review.”
Smith knows that he needs to speed things along to comport with the 2024 election calendar.
That is why Democrats and their media allies threw a fit when the Supreme Court agreed to hear arguments in the J6 case, but not at the breakneck pace they wanted.
Democrats are slowly realizing that their lawfare efforts may not be their saving grace in 2024.
