Reports: Man accused of raping woman on Philadelphia train has been living in US illegally since 2015

Reports of a heinous crime in one of America’s most historic cities show just how destructive President Joe Biden’s open borders policies could be for Americans.

According to the Daily Maila 35-year-old man accused of raping a woman on a Philadelphia train has been living in the U.S. illegally since 2015, when Biden was vice president.

Fiston Ngoy, who is now facing charges for sexual assault, “overstayed student visa and was not deported after criminal convictions,” the Daily Mail revealed.

The case has garnered nationwide attention over reports that witnesses to the alleged rape opted to point their phones toward the attacker, apparently filming the assault, rather than helping the victim.

“Multiple arrests”

Fox News and Tucker Carlson Tonight report Ngoy first entered the U.S. legally in 2012.

“However,” Fox reported exclusively this week, “the 35-year-old Congolese national’s visa was terminated in 2015 because he failed to remain a student.”

Fox’s report adds:

Meanwhile, court records show that he racked up “multiple arrests and two misdemeanor convictions, one for controlled substances and one for sexual abuse.” Ngoy [pleaded] guilty in 2017 in Washington, D.C. to the sexual abuse misdemeanor and was sentenced to 120 days in prison and nine months probation.

Despite the criminal convictions, Ngoy was never deported. According to the Associated Press, authorities said that on Oct. 13, 2021, “Ngoy ripped [a] woman’s pants off and proceeded to rape her for somewhere between six and eight minutes before officers boarded the train and detained him.”

“An open investigation”

Speaking at a press conference Monday, Transit Police Chief Thomas Nestel III told reporters that the incident should leave people “angry” and “disgusted.”

“We want everyone to be angry, disgusted, and to join us in being resolute in keeping our system safe,” Nestel said, according to Fox.

Prosecutors in Philadelphia don’t anticipate that charges will be filed against other passengers on the train who failed to intervene in the alleged assault. “It’s still an open investigation, but there is no expectation at this time that we will charge passengers,” a spokesperson for the Delaware County District Attorney’s office told the AP.

District Attorney Jack Stollsteimer said in a statement of his own to the outlet that “Pennsylvania law does not allow for the prosecution of a passenger who may have witnessed a crime.” Witnesses are encouraged to come forward, he emphasized.
