During a hearing on Thursday, Rep. Thomas Massie (R-WV) asked Attorney General Merrick Garland if a man who was seen in several videos inciting violence at the January 6 Capitol riot was a federal agent. Massie was suspicious that the man may in fact be an agent or an asset, given the fact that he has not been charged.

“As far as we can determine, the individual who was saying he’ll probably go to jail, he’ll probably be arrested, but they need to go into the Capitol the next day, is then the next day directing people to the Capitol, and as far as we can find, this individual has not been charged with anything,” Massie said. “You said this was one of the most sweeping investigations in history. Have you seen that video or those frames from that video?”
“So, as I’ve said at the outset, one of the norms of the Justice Department is to not comment on impending ongoing investigations and not comment about particular scenes or particular individuals,” Garland answered.
Massie pressed on, saying, “I was hoping today to give you an opportunity to put to rest the concerns that people have that there were federal agents or assets of the federal government present on January 5th and January 6th. Can you tell us without talking about particular videos how many agents or assets of the government were present on January 6th? Whether they agitated to go into the Capitol? And if any of them did?”
“I’m not going to violate this norm of the rule of law,” Garland stated. “I’m not going to comment on investigation that’s ongoing.”
Fox News host Greg Gutfeld was quick to slam Garland after the hearing, calling him incompetent.
“He talks about how he reads stuff in the news. He had no idea about what happened with the Department of Interior last week. The dude is the attorney general. Didn’t know that an ‘insurrection’ happened?” Gutfeld said, going on to point out that Garland is simultaneously targeting parents at school board meetings for potential investigation if complaints are made.
“He has no idea about the statistics behind the police-suspect interactions. He gets all of the direction from secondary undocumented opinions,” he added. “I mean, if they’re going to target U.S. citizens, you should be getting your info not from Buzzfeed, right? You are talking about ruining people’s lives. You’re an attorney general, not an associate producer for ‘The View’ — it’s disgusting.”
