A federal judge in Texas has rejected an attempt by President Joe Biden to unilaterally block the state’s new abortion ban.
Biden’s Department of Justice (DOJ) had asked United States District Judge Robert Pitman to stop the law from being enforced, making good on a threat from the president to stop Texans from making laws that he and his supporters don’t like. But according to Fox News, Pitman handed down a brief order Thursday denying the request for a temporary restraining order.
“Complex, important questions”
The judge said that the law presents “complex, important questions” that need to be addressed in court, not summarily dismissed in favor of Biden’s demand for an expeditious, partisan decision.
“[T]his case presents complex, important questions of law that merit a full opportunity for the parties to present their positions to the Court,” Pitman wrote Thursday, as Fox reported. “Accordingly, IT IS ORDERED that the United States’ Opposed Motion for Expedited Briefing Schedule, (Dkt. 13), is DENIED.”
The case will be heard on Oct. 1. According to Politico, Texas has until Sept. 29 to respond to Biden’s move, and then the DOJ can issue its case.
The Texas law bans most abortions after about six weeks gestation and allows private individuals to sue abortion doctors and those who help facilitate abortions, which the Biden Justice Department called “an unprecedented scheme that seeks to deny women and providers the ability to challenge S.B. 8 in federal court.”
“This attempt to shield a plainly unconstitutional law from review cannot stand,” the DOJ said, according to Fox.
Biden’s radical politics
After the law went into effect, the nominally Catholic Biden revealed to Americans for the first time that he does not think life begins at conception and vowed to do everything in his power to bully Texas into compliance with his extreme vision of “safe and legal” — but not rare — abortion without restrictions.
“I respect those who believe life begins in the moment of conception — I respect that,” he said, according to a separate report from Fox. “Don’t agree but I respect that.”
Biden also ripped the Texas law as “un-American” and said he would bring a “whole-of-government” response to crush Texans’ democratic will after the Supreme Court declined to stop the ban in a 5–4 decision.
Abortion rights supporters fear the Texas law significantly weakens Roe v. Wade and opens the door for the Supreme Court to potentially strike it down completely.
But contrary to Biden’s claim, Texans have a right to make their own laws, and aren’t bound by a Supreme Court precedent from 50 years ago to do Biden’s bidding.
