A 31-year-old NYPD cop was shot and killed by a career criminal during a traffic stop in Queens on Monday evening in a “senseless act of violence,” officials and law enforcement sources said.
Officer Jonathan Diller, a married father of a 1-year-old boy, was shot in the stomach after police tried to remove the suspect, identified by sources as Guy Rivera, from the passenger seat of the car near 19-19 Mott Avenue in Far Rockaway, according to the NYPD and sources.
Diller, who had three years on the force, fell to the ground and screamed that he had been “hit,” after the suspect opened fire, according to witness Deon Peters.
According to police officials, two NYPD officers approached a car at 5:48 pm Monday, which was illegally parked in a bus stop. Two men were in the car, and the passenger displayed a gun and pointed it at the officers. They ordered him to get out of the car, and he refused. While the officers were trying to get him out of the car, he then shot Officer Diller in the torso, underneath his bullet‑resistant vest.
The report explains that, despite being shot, Diller heroically managed to get the gun away from the shooter when the weapon fell to the ground.
Diller’s partner then shot the suspect in the back.
Officer Diller was rushed to the hospital in critical condition, but did not survive.
The suspect was also taken to the hospital, but his condition is yet unknown, as of this report.
The suspect was identified as Guy Rivera, 34, a career criminal with 21 prior arrests, including the following:
- 9 felony arrests, including assault & gun charges
- Sent to prison in 2011 over a first-degree assault charge, released in 2014.
- Back to prison in 2016, released in 2021, for criminal possession of a controlled substance. Parole in that case just ended last year.
The driver of the car, identified as Lindy Jones, 41, also has a criminal record:
- Jones has 14 prior arrests,
- Convicted of attempted murder and robbery in 2003, served ten years in prison and was released in 2013.
- Jones was arrested in April 2023 on a gun charge, but was already back out on the street.

NYPD Commissioner Edward Caban announced, “Tonight this city lost a hero, a wife lost her husband, and a young child lost their father. We struggle to find the words to express the tragedy of losing one of our own. The work that Police Officer Jonathan Diller did each day to make this city a safer place will NEVER be forgotten. Our prayers are with his family, loved ones, and brothers and sisters in blue.”
NYC Mayor Eric Adams wrote, “We lost one of our sons tonight, and I am heartbroken for his wife, family, and all New Yorkers. Officer Jonathan Diller was just doing his job in Queens, working to keep his fellow New Yorkers safe, and a senseless act of violence took his life — a senseless act carried out by a dangerous individual with a gun and a total disregard for our people in uniform. Let us come together in this devastating moment and pray for his family and our fellow officers.”
