David Lacey, husband of former Los Angeles County District Attorney Jackie Lacey, will not face jail time after he pulled out a gun to protect his property when Black Lives Matter protesters showed up to the couple’s home last year demanding to speak to Jackie. On March 2, 2020 before dawn the Black Lives Matter group showed up to the home chanting, banging drums and ringing the doorbell.
David Lacey opened the door pointed his gun at the Black Lives Matter protesters demanding they leave his property or he would fire his weapon. He then told protesters he was calling police, went back inside his home and shut the door.

David Lacey was charged with three misdemeanor counts of assault with a firearm. Each count would carry up to one year in county jail. However, on Thursday Superior Court Judge David Stuart decided to allow him to enter into a diversion program. As part of the agreement he will need to complete 100 hours of community service and attend anger management and gun safety classes. He can also not be in possession of a firearm for the duration of the agreement, which is 18 months.
“We maintain David’s innocence. He was protecting his wife and family from protesters the night of the incident. This diversion allows David to avoid the risks of a jury trial. We are happy the judge and the attorney general agreed diversion was appropriate.” – Samuel E. Tyre, Lacey’s attorney
