SAN ANTONIO — An Afghan migrant on the terror watchlist spent nearly a year inside the U.S. after being apprehended and released by Border Patrol agents in 2023, U.S. officials tell NBC News. The Afghan national was arrested last month and then released again by an immigration judge who was not told he was a national security threat.
Mohammad Kharwin, 48, is currently out on bond as he awaits an immigration hearing in Texas, scheduled for 2025. There are no restrictions on his movements inside the United States, U.S. officials said.
Kharwin was initially apprehended on March 10, 2023, near San Ysidro, California, after crossing the Mexico-U.S. border illegally.
NBC News explains that when Border Patrol agents first apprehended Kharwin after he crossed the border into California last year, they suspected he was on the US terror watchlist, “because one piece of information matched an individual on the list,” but they couldn’t confirm it, so they let him go.
The agents did take Kharwin’s biometric data, but reportedly did not contact either the FBI or Immigration and Customs Enforcement at the time.
After being turned loose, “Kharwin was then able to apply for asylum and work authorization, and fly domestically in the United States,” NBC reported.
However, Kharwin actually is on the FBI’s terror watch list, and is a member of Hezb-e-Islami, or HIG, a terrorist organization responsible for attacks in Afghanistan that killed at least nine American soldiers and civilians between 2013 and 2015, the report states.
After Kharwin had been allowed to roam free anywhere in the United States for nearly a year, the FBI tipped off ICE in February of this year that he had potential terror ties and may be a national security threat. ICE tracked him down in San Antonio, Texas and arrested him on Feb. 28.
Kharwin was held in an ICE detention center for one month until his court hearing on March 28. There, an immigration judge ordered him released. According to the report, ICE did not tell the judge about his terrorism connections.
Kharwin paid the $12,000 bond on March 30, and got a “get-out-of-jail-free card,” with an order to come back for his next court hearing – in a year.

NBC reports that in February, the FBI tipped off ICE that he may be a national security threat, and ICE later arrested him in San Antonio, TX.
He was held in ICE detention until his court hearing two weeks ago, when a federal immigration judge ordered he be released on bond, despite ICE prosecutors arguing he’s a flight risk.
He is now out on bond, able to roam the U.S., with another court date next year.
