The Christian Missouri school College of the Ozarks has filed a lawsuit challenging the Biden administration’s executive order aiming to combat discrimination based on gender identity.
The religious college says that Biden’s act to require “private religious colleges to place biological males into female dormitories and assign them as females’ roommates” is not in line with the Christian school’s views.
The suit claims the directive prohibits the college and its staffers and administrators from “telling students that they only qualify for access to dormitory and dormitory room placements based on their biological sex.”
“For decades, the College has prohibited male students from living in female dormitories, and vice versa, regardless of whether those students identify with their biological sex. The College likewise separates intimate spaces such as showers and bathrooms in its dormitories. The College regularly makes statements communicating these same policies, including this month as it arranges student housing for the fall.”
Because the administration did not “take into consideration the College or other entities with similar student housing policies in promulgating the Directive,” the college wants the court to set aside the directive.
The complaint states that the Biden administration’s requirement to reorganize its housing system creates “immediate upheaval within the College’s continuing enforcement of its housing policies, but because the College is engaged in time-sensitive statements and planning right now—with current and incoming students—describing its housing policies for the fall semester, and the Directive threatens massive penalties on the College for maintaining its policies and making statements about them.”
The suit was filed by the Alliance Defending Freedom (ADF) in the Western District of Missouri on behalf of the College of the Ozarks.
On his first day in office, Biden signed an order that aims to fight “discrimination on the basis of gender identity or sexual orientation, and to fully enforce Title VII and other laws that prohibit discrimination on the basis of gender identity or sexual orientation.”
College of the Ozarks President Dr. Jerry C. Davis and ADF Senior Counsel Julie Marie Blake slammed the Biden administration over what they deemed an attack on core religious values and a “politically motivated and inappropriate redefinition of ‘sex.’”
“The government cannot and should not force schools to open girls’ dorms to males based on its politically motivated and inappropriate redefinition of ‘sex,’” said ADF Senior Counsel Julie Marie Blake. “Women shouldn’t be forced to share private spaces—including showers and dorm rooms—with males, and religious schools shouldn’t be punished simply because of their beliefs about marriage and biological sex. Government overreach by the Biden administration continues to victimize women, girls, and people of faith by gutting their legal protections, and it must be stopped.”
