It would appear that the Biden administration is not playing by the rules when it comes to protecting federal records.
According to a recent lawsuit, one of the agencies in the administration has deleted email records that were supposed to be preserved.
Stephen Miller, a former Trump adviser who now heads America First Legal (AFL), filed the suit against the Health and Human Services (HHS) Department.
Supposed to Save Them
Miller has filed this suit, at least in my opinion, to draw attention to the National Archives and Records Administration’s (NARA) duplicity in its pursuit of Trump and treatment of Joe Biden.
America First Legal Vice President Dan Epstein stated, “If the National Archives decides not to use the legal authorities it has regarding federal records, it certainly shouldn’t make up legal authority that it doesn’t have when it comes to presidential records.
“We expect our government to act in a transparent and accountable way and exercise equanimity when it decides to investigate certain allegations. We clearly haven’t seen that in this case.”
AFL believes that if it wins this case, it will impact Special Counsel Jack Smith’s classified documents case against Trump.
The argument being made by AFL is that Trump was being held to a different standard than everyone else. And worse yet, nobody else is suffering anything close to the repercussions faced by Trump.
The case is linked to a Freedom of Information Act request with the Centers for Disease Control and Prevention (CDC).
During this request, it was revealed that the CDC, which falls under the umbrella of HHS, was deleting emails from lower-level staffers 30 days after having left their posts.
The CDC confirmed this is its practice, stating, “That is correct.
“Unless they were a capstone director/manager etc., it is my understanding all other employees’ emails are deleted 30 days after they leave the agency.”
NARA also confirmed this, with AFL responding, “In effect, it appears that NARA entrusts individual CDC employees to decide which emails can be automatically deleted.”
Now it is a waiting game to see if Miller’s group can pull this off to help Trump.
