Left wing activist John Sullivan, 26, who is facing criminal charges over his role in the incursion at the Capitol was paid big bucks by CNN and NBC for his footage of a woman being shot.
Lawyers for Sullivan used the payments from the networks as evidence that he was not a rioter but was acting as a journalist.
“Defendant is legitimately self-employed as a documentarian and it is oppressive to require that he not be allowed to continue his primary area of employment for an extended period of time,” Steven R. Kiersh, the Sullivan lawyer, wrote in a court filing in which he argued for Sullivan to be allowed to continue using Facebook and Twitter.
However, Prosecutors have used video showing Sullivan riling up the crowd calling for burning down the building and egging others on to commit acts of vandalism once they entered.
“We accomplished this shit. We did this together. Fuck yeah! We are all a part of this history,” he said in a video cited by prosecutors.
“Let’s burn this shit down,” he also allegedly said.
In one video, after a group breached the Capitol one man grabs a megaphone and said, “We need to remain calm now. We’ve made our point. Let’s be peaceful.”
“F—k that sh*t,” Sullivan says. “Push!” Several times throughout the video, he can be heard saying, “I got a knife.” (He now claims that he didn’t actually have a knife: “I used that to navigate myself to the front of the crowd.”)
Sullivan found his limelight when he filmed the fatal shooting by Capitol police of unarmed Air Force veteran Ashli Babbit. His lawyers used the invoices from CNN and NBC to show he was paid $35,000 for the rights to air the footage. Sullivan was also paid $5,000 from Left/Right Productions and $2,500 from Australia’s ABC.
A federal judge ruled that Sullivan may use Facebook and Twitter however, he must cut ties with the far left activists group insurgence USA. Sullivan is also facing additional federal charges in Utah from a June 30,2020 incident when a person was shot and injured during a protest against police.
Worried about the optics some groups within the Black Lives Matter movement have shunned Sullivan.
