A Marvel movie star in trouble with the law received more bad news this week from the judge overseeing his case.
According to USA Today, actor Jonathan Majors’ attempt to have assault and harassment charges dismissed by the court was rejected by the judge.
The charges stem from an earlier incident in which Majors was convicted for attacking his then-girlfriend in the backseat of a vehicle.
Judge Michael Gaffey’s decision to reject Majors’ motion to dismiss the charges came down on Monday, marking a major setback for the up-and-coming movie star.
What’s going on?
Majors was convicted of reckless assault in the third degree and harassment in the second degree in the attack on his former girlfriend, Grace Jabbari.
USA Today noted:
The defense filed a motion on Feb. 5 to set aside the Dec. 18 verdict, which convicted Majors of reckless assault in the third degree and harassment in the second degree. The judge reviewed the motion, as well as prosecutors’ filing opposing the move and Majors’ attorneys’ response, before denying the request.
Majors’ lawyers argued that “his conviction of reckless assault in the third degree should be set aside because the court erred in submitting the count to the jury.”
The judge obviously disagreed, saying that the reckless assault charge was presented to the court as an “alternate theory to the intentional assault count.”
The judge added, “A person is guilty of harassment in the second degree when, with intent to harass, annoy or alarm another person, he ‘strikes, shoves, kicks or otherwise subjects another person to physical contact, or attempts or threatens to do the same.”
Majors’ defense also argued that his former girlfriend was the aggressor in the situation.
No jail time
According to Fox5DC, Majors learned Monday during sentencing that he will not be serving jail time as a result of the convictions.
The report noted that Majors was “sentenced to probation and ordered to complete a year-long counseling program.”
Additionally, the judge ordered him to continue mental health therapy and to complete an in-person batterer’s intervention program. He was facing a year in prison for the convictions prior to the sentence.
Majors, who played Kang the Conqueror in the Marvel Universe, was immediately fired by Marvel Studios after he was found guilty earlier this year.
