Manhattan District Attorney Alvin Bragg filed a motion Tuesday to hold former President Trump in contempt of court, claiming he violated the gag order imposed upon him by publishing three social media posts relating to two known witnesses in his criminal trial — Michael Cohen and Stormy Daniels.
Bragg is urging Manhattan Judge Juan Merchan to also warn Trump that “future violations” of the gag order can be punished “not only with additional fines, but also with a term of incarceration of up to thirty days.”
Merchan last month imposed a gag order on Trump, due to his “prior extrajudicial statements.” Merchan said they established “a sufficient risk to the administration of justice.”
Merchan has prohibited Trump from making or directing others to make public statements about witnesses or about counsel in the case — other than Bragg — or about court staff, DA staff or family members of staff, the report explains.
Trump is also banned from commenting about any prospective or chosen juror.
Bragg claims Trump has already violated the gag order three times, and wants to fine him $1,000 per violation.
Bragg has pointed to posts where Trump referenced his former lawyer Michael Cohen. However, Cohen is still free to do interviews or make social media posts spewing venom against Trump all he wants.
Trump blasted the entire process in a Truth Social post Tuesday morning.
“This conflicted, Trump Hating Judge won’t let me respond to people that are on TV lying and spewing hate all day long. He is running rough shod over my lawyers and legal team. The New York System of “Justice” is being decimated by critics from all over the World. I want to speak, or at least be able to respond. Election Interference! RIGGED, UNCONSTITUTIONAL TRIAL! Take off the Gag Order!!!” he wrote.
Political strategist Alex Lorusso announced, “BREAKING: DA Alvin Bragg has filed a motion to hold Donald Trump in contempt for alleged violations of his partial gag order and urges the court to warn Trump that he could be jailed for 30 days if he violates the order again.”
