The Supreme Court made its presence felt in a big way.
Democrats are going to hate the latest decision.
And this massive Supreme Court ruling will have Donald Trump jumping for joy.
Even cases that don’t appear to involve Donald Trump end up involving Donald Trump.
The Supreme Court acted on behalf of sanity and the safety of children by allowing an Idaho law banning transgender surgeries for minor children to go into effect.
Back in December, a lower court issued a stay blocking the law, but the Supreme Court overruled that decision.
The court noted that the stay didn’t affect the two plaintiffs involved who still could wait for the case to play out through the legal system.
“The plaintiffs face no harm from the partial stay the State requests,” the three justices’ ruling read. “Even with it, the district court’s preliminary injunction will operate to prevent state authorities from taking any action to interfere with their ability to access the particular drug treatments they seek.”
Justices Clarence Thomas, Neil Gorsuch, and Samuel Alito used this decision to also fire a shot across the bow of judges at the district court level who took it upon themselves to issue nationwide injunctions and block federal policies from taking effect.
The justices instructed judges to take note of how this case let the policy go into effect except for the plaintiffs who brought the case and could make the argument they would suffer actual harm.
“Lower courts would be wise to take heed. Retiring the universal injunction may not be the answer to everything that ails us,” the opinion began.
“But it will lead federal courts to become a little truer to the historic limits of their office; promote more carefully reasoned judicial decisions attuned to the facts, parties, and claims at hand; allow for the gradual accretion of thoughtful precedent at the circuit level; and reduce the pressure on governments to seek interlocutory relief in this Court,” the justices added.
The number of nationwide injunctions exploded under Donald Trump to 55 in his four years in office compared to courts issuing 19 in Barack Obama’s two terms.
Gorsuch, Thomas and Alito explained that the end of nationwide injunctions would tamp down the hysteria surrounding the courts if judges stopped acting like super legislatures and usurping the policy-making authority from Congress and the president.
“A return to a more piecemeal and deliberative judicial process may strike some as inefficient. It may promise less power for the judge and less drama and excitement for the parties and public. But if any of that makes today’s decision wrong, it makes it wrong in the best possible ways, for ‘good judicial decisions are usually tempered by older virtues,’” Thomas, Alito and Gorsuch concluded.
This decision was a clear warning that conservative justices are looking to end universal injunctions and that if liberal activists once again abuse this process by having some leftist judge in California block every Trump immigration executive order the Supreme Court is prepared to step in and put a stop to this foolishness.
