The attorney representing Daniel Penny expressed dismay following the decision by New York City prosecutors not to pursue charges against a man they deemed acted in self-defense during a recent subway altercation.
In an interview with Fox News host Jesse Waters, Thomas Kenniff conveyed a mix of emotions, stating he was “happy” that Younece Obuad, identified as the subway shooter, wasn’t charged for defending himself against Dajuan Robinson.
Kenniff commended the Brooklyn district attorney’s exercise of prosecutorial discretion, stating, “Somebody who was forced to defend himself and others shouldn’t be subjected to a criminal indictment.”
Kenniff, however, emphasized his grievances too, asserting it’s “absolutely frustrating” to witness his client being prosecuted while acting in self-defense.
He further emphasized the similarity between Penny’s predicament last year and the recent subway shooting.
Penny, a Marine veteran, found himself in legal trouble last year when he was arrested and charged with second-degree manslaughter and criminally negligent homicide for restraining Jordan Neely, a homeless man who had allegedly threatened subway passengers. Neely subsequently died following the incident.
Penny faces manslaughter charges stemming from the incident involving Neely, who exhibited aggressive behavior on a Manhattan F train in May 2023.
Despite being out on $100,000 bail, Penny could face up to 19 years in prison if convicted. His motion to dismiss the charges was rejected by a judge in January.
Kenniff asserted during the interview with Waters that Thursday’s shooting underscores the lawlessness prevailing in New York City’s subways, a situation that compelled Penny to act almost two years ago.
He highlighted the vulnerability felt by many subway riders and the unfortunate consequence of facing persecution for attempting to defend oneself and others.
Regarding the recent altercation, Kenniff cautioned against approaching such situations with hostility, as depicted in the video footage of the subway shooting. The verbal altercation escalated into a physical confrontation before Robinson brandished a handgun, triggering chaos among passengers. Robinson was shot multiple times by Obuad and remains hospitalized in critical condition.
