An Arizona rancher charged with murder in the death of a Mexican national found shot on his border property is scheduled to face trial on Thursday after several delays.
The case of the State of Arizona v. George Alan Kelly is scheduled to begin jury selection at 8:30 a.m. local time on Thursday in Santa Cruz Superior Court, according to court records. The parties most recently had a pre-trial conference on Monday, in which they went over jury instructions.
Kelly, who is in his 70s, is charged with second-degree murder and aggravated assault with a deadly weapon in connection to the Jan. 30, 2023, shooting death of 48-year-old Gabriel Cuen Buitimea, of Nogales, Mexico. Law enforcement found the man, later identified as Buitimea, shot to death on Kelly’s property near the U.S.-Mexico border.
The incident occurred when Kely said he saw a group of men, dressed in camouflage, carrying AK-47 rifles and large backpacks, walking through the trees around his home.
The rancher said he went out to his porch with his rifle, and one of the men “pointed an AK-47 right at him.” Kelly said he then fired several “warning shots” into the air and saw the men run toward the desert.
Kelly then called and reported the incident to the Border Patrol. Later in the evening, he went to check on his horses and found a man’s body on his property.
Kelly was first charged with first-degree, premeditated murder and was held on $1 million bond for weeks. After national outrage, the charge was downgraded to second-degree murder and he was released from jail.
The report explains that the jury selection process is expected to take place Thursday and Friday, and opening statements of the trial are set for next Tuesday.
