Senator Adam Schiff mortgage fraud allegations have been formally referred to the Department of Justice, according to a letter sent by the U.S. Federal Housing Finance Agency (FHFA) Director William Pulte in May 2025. The letter, addressed to Attorney General Pam Bondi and Deputy Attorney General Todd Blanche, outlines alleged misrepresentations related to multiple mortgage documents spanning from 2003 to 2019.
The Adam Schiff mortgage fraud referral stems from property records associated with a home in Potomac, Maryland, where Schiff and his wife reportedly claimed the property as their primary residence while simultaneously holding elected office in California and receiving a California tax exemption for a different property listed as their primary residence.
According to Pulte, internal investigations conducted by the Fannie Mae financial crimes division concluded that Schiff engaged in “a sustained pattern of possible occupancy misrepresentation” on five Fannie Mae-backed loans. These types of representations can impact interest rates, as lenders typically offer more favorable terms for primary residences compared to second homes due to perceived risk.
The letter explains that Schiff and his wife obtained a $610,000 loan with a 5.625% rate in 2003 by listing the Maryland property as their principal residence. They reaffirmed that designation in multiple subsequent refinancing documents, including in 2009, 2011, 2012, and 2013. However, Schiff was at that time serving in Congress, representing California.
Meanwhile, Schiff claimed a homeowner’s exemption in Burbank, California, which reduced property taxes based on the property also being a primary residence. FHFA cites this as a potential dual representation that could constitute fraud under federal statutes related to mail fraud, wire fraud, and false statements to financial institutions.
In a public statement, a spokesperson for Schiff previously asserted that both properties were occupied throughout the year and designated as primary residences only to distinguish them from vacation properties. Nonetheless, FHFA Director Pulte emphasized that occupancy status has a direct financial impact on loan terms and that misrepresentation could undermine the integrity of the U.S. mortgage system.
Comparable cases were cited in the FHFA letter, including the 2023 conviction of former Baltimore City State’s Attorney Marilyn Mosby and a 2025 guilty plea by a Missouri resident in a separate mortgage fraud case. The FHFA has pledged to cooperate with the DOJ should it choose to pursue further investigation or prosecution.
While the Department of Justice has not publicly commented, former President Donald Trump responded on social media, labeling Schiff a “scam artist” and calling for prosecution. Schiff released a video statement in which he rejected the allegations and attributed the accusations to long-standing political attacks.
As of now, no formal charges have been filed, and it remains to be seen whether the DOJ will act on the FHFA’s referral. The Adam Schiff mortgage fraud case highlights the ongoing scrutiny over financial disclosures and property documentation among elected officials.
