A routine traffic violation has dramatically altered the future of a Georgia college student and her family after authorities discovered they had been living illegally in the United States for nearly 15 years.
Ximena Arias-Cristobal, 19, was pulled over by Dalton police on May 5 when she failed to obey a “no turn on red” sign, setting in motion a chain of events that exposed her illegal alien status.
Jack Posobiec was one of many on X to call out one striking detail from the story.
During the stop, Arias-Cristobal was unable to produce a valid driver’s license.
She initially claimed to have an international driver’s license but later admitted she didn’t have the document with her, according to the arrest report.
The teenager told officers that her mother had taken away her driving privileges and instructed her not to operate a vehicle, information that raised questions during the routine traffic stop.
Officers attempted to contact the teen’s mother, who was also the owner of the vehicle, but communication proved difficult as neither she nor other family members spoke English, according to police reports.
“The officer who pulled her over attempted to speak to the teen’s mom and the owner of the car, but neither of them spoke English,” Posobiec specifically highlighted from the report.
Another commenter said, “Foreigners who play the ‘i can’t speak English’ game should face criminal charges and/or be fired from their jobs. Whatever they are.”
Arias-Cristobal was subsequently arrested and charged with driving without a valid license and failure to obey traffic control devices.
These relatively minor offenses led to a much more serious consequence when she was transported to Whitfield County Jail.
The facility participates in the U.S. Immigration and Customs Enforcement’s 287(G) program, which is specifically designed to identify individuals who are in the country illegally after they’ve been arrested for violations of Georgia law.
When processed through the federal database at the jail, Arias-Cristobal’s non-citizen status was confirmed, leading to her transfer to ICE’s Stewart Detention Center in Lumpkin, Georgia.
The college student’s father, Jose Francisco Arias-Tovar, is also being held at the same detention center.
He was arrested last month after being pulled over for speeding – driving 19 miles over the posted limit, the New York Post highlighted.
Arias-Tovar owns his own company but was denied proper documentation to remain legally in the United States, according to reports.
It remains unclear whether he had previously applied for citizenship.
The Post noted that the family’s history in America began in 2010 when Arias-Cristobal was brought into the country at just four years old.
Her parents relocated from Mexico City to the Dalton area, which is situated approximately 30 miles from the Tennessee-Georgia border.
Despite living in Georgia for most of her life, Arias-Cristobal has been paying out-of-state tuition at Dalton State Community College due to her non-citizen status.
Hannah Jones, a woman for whom Arias-Cristobal previously worked as a babysitter, has established a GoFundMe campaign to raise money for legal representation and bond for the teenager.
Jones noted that Arias-Cristobal was not eligible for the DACA program, having arrived in the country after the program’s cutoff date.
Chattanooga-based immigration attorney Terry Olsen has raised concerns about the handling of such cases.
“We do see that ICE is really trying to find any and all methods to say that an international has some way violated the process and their status,” Olsen told local media station WTVC.
Olsen further criticized the agency’s approach, stating, “What’s concerning is that when they are being checked at these checkpoints or at the stops, ICE does not have their entire immigration file in front of them, they’re not looking at all of it, and they’re just relying on one item.”
“This is a civil rights issue.”
The situation is likely to impact the entire family, according to Olsen.
He predicts that Arias-Cristobal’s mother will be arrested and deported within a month, with her daughters being taken with her to keep the family together.
