Federal judges in New York and Texas on Wednesday issued temporary orders preventing the Trump administration from deporting Venezuelan migrants being held in detention facilities in the two states.
The Trump administration is attempting to deport the migrants under the Alien Enemies Act.
Those being held are purportedly members of the Venezuelan gang Tren de Aragua, an assertion their attorney denies, according to The Associated Press.
Three of the alleged gang members are being held in a facility in Texas, while two are being held in a facility in New York.
Judge Fernando Rodriguez Jr. signed a temporary restraining order in Texas while Judge Alvin K. Hellerstein Judge Alvin K. Hellerstein in New York signed a similar order.
On Monday, the Supreme Court ruled that the Trump administration could use the Alien Enemies Act to deport Venezuelans that were accused of being gang members, but it also ruled the administration had to let the alleged gang members legally fight deportation orders.
