Considered a “huge blow to Kamala,” the Supreme Court issued an order impacting one state after the Biden-Harris administration fought to keep noncitizens on the voter rolls.
With a 6-3 decision that was at once a big win and commonsense, the high court swiftly responded to an emergency appeal from Virginia Attorney General Jason Miyares amid a lawsuit from the Department of Justice.
Now, after the federal government had sought to prevent the commonwealth from removing 1,600 noncitizens from their rolls, the majority ruled in favor of staying an injunction, allowing election integrity to prevail.
“The application for stay presented to The Chief Justice and by him referred to the Court is granted. The October 25, 2024 order of the United States District Court for the Eastern District of Virginia…is stayed pending the disposition of the appeal in the United States Court of Appeals for the Fourth Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought,” detailed the order from the court noting the dissent came courtesy of the liberal justices.
“Justice Sotomayor, Justice Kagan, and Justice Jackson would deny the application,” concluded the order.

Reacting to the ruling, Virginia Gov. Glenn Youngkin (R) issued a statement that read, “We are pleased by the Supreme Court’s order today. This is a victory for common sense and election fairness. I am grateful for the work of Attorney General @JasonMiyaresVA on this critical fight to protect the fundamental rights of U.S. citizens. Clean voter rolls are one important part of a comprehensive approach we are taking to ensure the fairness of our elections.”
“Virginians also know that we have paper ballots, counting machines not connected to the internet, a strong chain of custody process, signature verification, monitored and secured drop boxes, and a ‘triple check’ vote counting process to tabulate results,” he continued. “Virginians can cast their ballots on Election Day knowing that Virginia’s elections are fair, secure and free from politically-motivated interference.”

The Justice Department argued against clearing the rolls within the 90 days before the election, citing the National Voter Registration Act and concern that eligible citizens would be purged, and defended the presence of noncitizens by stating “Notably, applicants have provided no reason to believe that any noncitizens have voted in past Virginia elections, or that any are likely to do so in the upcoming election.”
Sounding off on the decision, syndicated radio host Mark Levin ripped into the judicial activism that had required the legal battle in the first place, tearing into what he suspected Vice President Kamala Harris intended were she to win the White House.
“No wonder Kamala Harris wants to destroy the independence of the Supreme Court,” he wrote on X. “No wonder Kamala Harris wants to add seats to the Supreme Court so she can then pack it with leftist ideologues. The Court just ruled that Virginia is free to remove noncitizens from its voter rolls. Now, you’d think this is a matter that would not require any judicial intervention. But the Harris-Biden regime’s DOJ brought a preposterous lawsuit to stop Virginia. The Biden-appointed federal district judge sided with the DOJ. Next, a panel of activist appellate judges upheld the district court judge’s ruling.”
“But for the Supreme Court, noncitizens would be voting in this election, as demanded by the Harris-Biden regime and the Democrats — just as they oppose voter identification while they usher in millions of unvetted illegal aliens,” added Levin, speaking to the “border czar’s” failures at national sovereignty.

Surprising many, the Harris campaign had reportedly shifted campaign advertising spending from the battleground state of North Carolina to Virginia while former President Donald Trump planned to hold a rally in Salem on Saturday, suggesting the blue state could be in play as readily as the swing states.
With that in mind, the ruling to allow Virginia to enforce election integrity was readily deemed, “A huge blow to Kamala.”
