Popular satirical website the Babylon Bee has launched a legal offensive against the state of California, challenging newly enacted “deepfake” laws that could potentially muzzle parody and satire.
The lawsuit, filed in the U.S. District Court for the Central District of California, takes aim at legislation signed by Governor Gavin Newsom that targets the publication of what the state terms “materially deceptive content.”
The Daily Wire reported that the legal action comes in response to a series of laws passed by the California legislature, seemingly inspired by a tweet from Governor Newsom suggesting that parody videos should be “illegal.”
These new regulations require social media platforms to act as watchdogs, identifying and removing content deemed deceptive or labeling it appropriately.
Elon Musk punched Newsom back after he took aim at a parody ad for presidential candidate Kamala Harris the tech mogul had posted.
“The governor of California just made this parody video illegal in violation of the Constitution of the United States,” Musk wrote on X, accompanied with the ad again.
“Would be a shame if it went viral,” he added, as previously covered by Resist the Mainstream.
Seth Dillon, CEO of The Babylon Bee, expressed his concerns in an exclusive interview with the Daily Wire’s “Morning Wire” podcast.
“If we’re unable to publish satire without putting disclaimers all over it, and we’re going to face potential penalties if we don’t do that, then that’s a very serious issue,” Dillon stated.
“So we’re fighting back in every way that we can against laws that clamp down on speech.”
He emphasized the importance of fighting back against laws that restrict free speech.
The lawsuit, supported by the Alliance Defending Freedom, argues that these laws infringe upon core political speech protected by the First Amendment.
Kristen Waggoner, president of the Alliance Defending Freedom, criticized the legislation, stating, “These laws were passed by politicians to protect politicians from speech that they don’t like.”
California’s Attorney General Rob Bonta, Secretary of State Shirley Weber, Los Angeles County District Attorney George Gascón and Los Angeles City Attorney Hydee Soto are named as defendants in the lawsuit.
The Babylon Bee’s legal challenge is not isolated, per Daily Wire.
A conservative social media user, known as @MrReaganUSA, has also filed a lawsuit against California with the assistance of the Hamilton Lincoln Law Institute.
This separate action argues that the new laws chill free speech, particularly for political commentators who rely on satire and social media viewership for their livelihood.
Newsom has defended the legislation, claiming it focuses on AI-generated content that could “undermine the public’s trust through disinformation.”
However, critics argue that the laws’ broad scope threatens legitimate forms of political expression and satire.
The Bee’s complaint contends that satire and parody are protected under the First Amendment because they trust the American people to think and decide for themselves in the context of political debate.
This legal battle adds to a growing list of complaints against government entities related to the alleged censorship of conservative content.
The outcome of this case could have far-reaching implications for the future of political satire and online expression in the United States.
