The Arizona Supreme Court ruled Tuesday that the state can enforce its 160-year-old long-dormant law criminalizing all abortions except when it puts the mother’s life at risk.
This makes Arizona one of the states with the most strict abortion laws in the country after federal abortion protections were stripped with the ruling overturning Roe v. Wade in June 2022.
Pro-abortion critics dubbed it a ‘dark day for Arizona’ and President Joe Biden immediately responded to the ‘cruel’ ruling with a statement claiming it will subject Arizonans to an ‘extreme and dangerous ban.’
The Arizona Supreme Court used an old law from 1864 in their 4-2 decision, which provides no exceptions for abortion in the case of rape or incest, but allows a mother to get an abortion if their life is put in danger should they carry the fetus to term.
Arizona Gov. Katie Hobbs, a Democrat, wrote on social media: “It is a dark day in Arizona. We are just fourteen days away from one of the most extreme abortion bans in the country. But my message to Arizona women is this: I won’t rest, and I won’t stop fighting until we have secured the right to abortion. That is my promise to you.”

Meanwhile, U.S. Senate candidate Kari Lake, a Republican, released the following statement in a press release, also voicing her opposition to the ruling, and calling on Hobbs to find a solution:
Phoenix, AZ – Following today’s Arizona Supreme Court’s abortion ruling, Kari Lake released the following statement:
“In addition to covering the state of Arizona as a fair and honest journalist for 27 years, I have traveled to every corner of this state on the campaign trail. I speak to more Arizonans than anyone and it is abundantly clear that the pre-statehood law is out of step with Arizonans.
I am the only woman and mother in this race. I understand the fear and anxiety of pregnancy, and the joy of motherhood. I wholeheartedly agree with President Trump — this is a very personal issue that should be determined by each individual state and her people. I oppose today’s ruling, and I am calling on Katie Hobbs and the State Legislature to come up with an immediate common sense solution that Arizonans can support. Ultimately, Arizona voters will make the decision on the ballot come November.

Sen. Mark Kelly (D-AZ) also condemned the decision, saying, “This is going to criminalize doctors for doing their jobs. It’s going to have a devastating effect on the health and freedom of women in Arizona. It’s going to put lives at risk.”

Kelly tried to blame former President Donald Trump, although the ruling is contrary to what Trump has supported.
“Today’s decision by the Arizona Supreme Court reinstitutes a total abortion ban from the 1800s. This is the biggest step backward since the repeal of Roe v. Wade. Make no mistake, this is happening because of Donald Trump. We must work to restore abortion rights this November,” Kelly claimed.
