TEXAS – An investigation is currently underway after a Dallas police officer shot a suspect on Sunday night, leaving him in critical condition.
The suspect, who has been identified as Hernan Gutierrez, 35 years old, will face charges of aggravated assault on a public servant and was also wanted for a firearm-related federal probation violation.
Property management at 1910 Bennett Ave. informed Senior Cpl. Matthew McLain that a man believed to be involved in a stolen vehicle case, where the suspect rammed a police car, was present at the location. Upon arrival, McLain called for backup, and he and Officer Kimberley Esquivel found Gutierrez in the back parking lot of the apartment complex.
Despite the officers’ attempts to give commands, Gutierrez resisted and started struggling with them. The officers deployed a taser that proved to be ineffective, and Gutierrez pulled out a handgun, firing a single shot. Esquivel responded by shooting Gutierrez in the torso.
Gutierrez was taken to the hospital and remains in critical condition, while the officers involved did not sustain any injuries.
