U.S. District Court Judge Cormac Carney struck a blow for defenders of the Second Amendment in a dramatic ruling against the Democrat-dominated California government Monday. Judge Carney ruled that a California law restricting the sales of new handguns is in “total violation” of the Second Amendment.
According to Bongino Report, Carney wrote, “Californians have the constitutional right to acquire and use state-of-the-art handguns to protect themselves. They should not be forced to settle for decade-old models of handguns to ensure that they remain safe inside or outside the home.”
The judge issued an injunction taking effect in two weeks to give the California Department of Justice the opportunity to appeal the ruling, though previous attempts to bring the case before the United States Supreme Court have failed.

As reported by Fox News, Carney said that portions of the highly restrictive so-called “Unsafe Handgun Act,” violates the Constitution because it requires new handguns to feature:
- a chamber load indicator,
- a magazine disconnection mechanism,
- and microstamping capability.
Carney explained,
“No handgun available in the world has all three of these features. These regulations are having a devastating impact on Californians’ ability to acquire and use new, state-of-the-art handguns.”
While older handguns may be ‘grandfathered’ on a list or “roster” of guns passing a ‘safety test,’ Carney added, “Californians have the constitutional right to acquire and use state-of-the-art handguns to protect themselves.”
“They should not be forced to settle for decade-old models of handguns to ensure that they remain safe inside or outside the home,” the federal judge wrote.

According to Fox News, Chuck Michel, head of the California Rifle & Pistol Association said, “For decades this ‘roster’ law has deprived law-abiding citizens of the right to choose a handgun appropriate for their individual needs. If we can hold on to this great Second Amendment win, people will be able to choose from among thousands of the latest, greatest and safest handguns made today.”
