If you are attacked by a rapist or mugger, must you refrain from striking or kicking your attacker because you’re not “authorized” to use force? Law enforcement, after all, has been entrusted to the police.
Instituting a police force doesn’t oblige us to suicidal passivity in the face of violent attacks. Self-defense is a natural (pre-constitutional) right that cannot be legitimately stripped by any statute.
The same is true of self-defense exercised in collective – as incorporated states. In fact, the individual states, being sovereign entities, retain the right to defend their borders against illegal influx by unauthorized foreign nationals.
The creation of agencies of the Federal Gov’t authorized with functions of border security did not strip the states of sovereignty.
