The Biden administration has a loophole in the works to help the illegal immigrants Florida Governor Ron DeSantis flew from San Antonio, Texas, to Martha’s Vineyard, Massachusetts receive visas.
Newsweek reported that a sheriff’s office in Texas is suggesting pursuing criminal charges in connection with its investigation into flights transporting numerous illegals last fall.
“The Bexar County Sheriff’s Office has officially filed a completed criminal case with the Bexar County District Attorney’s Office regarding the incident from September 2022 where 49 migrants were flown to Martha’s Vineyard,” read a statement shared with the outlet on Monday.
“The charge filed is Unlawful Restraint and several accounts were filed, both misdemeanor and felony,” it adds.
The Biden administration has decided that all the immigrants involved, now considered potential victims of a “crime” according to the legal complaint from this particular sheriff, are eligible for certain considerations.
This comes on the heels of a “robbery for visas” scheme from last year that saw illegal immigrants abusing a workaround path to citizenship in obtaining “U-visas.”
A U-visa is a special visa granted to illegal immigrants who assist law enforcement in criminal investigations.
President Biden had pledged in the past to expedite the process for those awaiting U-visas.
MV Times reported that Rachel Self, an immigration attorney and resident of Martha’s Vineyard, who is involved in the legal initiative to bring charges against DeSantis, revealed on Monday that some of the asylum seekers have begun receiving bona fide determinations from the United States Citizenship and Immigration Services (USCIS) for their U nonimmigrant visas.
The exact number of individuals who have received these determinations is currently unclear, but Self expressed optimism that all 49 asylum seekers will ultimately be granted this special protection.
“The fact they are coming for some is indicative that they will come in for all because they were all victims of the same crime,” Self told the outlet.
Reports circulated late last year about a criminal ring that facilitated the acquisition of these special visas for illegal immigrants by orchestrating staged crimes in which the individuals portrayed themselves as victims.
Rambhai Patel and Balwinder Singh, for example, were apprehended and formally charged in federal court for orchestrating a scheme involving “robbery for visas.”
The two men from New York were responsible for eight armed robberies targeting mini marts and liquor stores throughout 2023, The New York Times reported.
There was notably an illegal immigrant present in all eight cases, either employed as a clerk or within the store. Subsequently, seven out of these eight immigrants applied for a U-visa from the USCIS.
The Department of Homeland Security under Biden’s administration, however, even acknowledged that the program is “not effectively managed and is vulnerable to fraud.”
What particularly caught the attention of investigators regarding Patel and Singh is that for one of their heists, they had to travel by airplane. The cost of this trip exceeded the amount they stole from the register, which raised suspicion among authorities.
An unnamed accomplice would eventually flip on Patel and Singh after being arrested, uncovering the details of the “robbery for visas” scheme. In sum, illegal immigrants would allegedly pay Patel and Singh $10,000 to stage robberies involving them.
The targeted stores would reportedly receive between $1,000 and $2,000 to serve as locations for these orchestrated crimes. Subsequently, Patel would purportedly engage lawyers to assist the “victims” in applying for their U-visas.
Each “robber” supposedly received $500, with Patel claiming the remainder of the proceeds.
