Fox News is now facing a lawsuit from the family of a journalist who was killed in Ukraine.
CNN reports that Fox has been hit with a wrongful death lawsuit that has been filed by the family of Oleksandra “Sasha” Kuvshynova’s parents.
This lawsuit comes roughly two years after Kuvshynova, a Fox News contractor, and Pierre Zakrzewski, a Fox News photojournalist, were killed in Ukraine.
Before we get to the lawsuit, we’ll recall the incident that led to Kuvshynova and Zakrzewski’s deaths.
What happened?
The incident took place in Ukraine on March 14, 2022. At the time, both Kuvshynova and Zakrzewski were covering the Russia-Ukraine war.
NPR reports, “Oleksandra ‘Sasha’ Kuvshynova, who was 24, accompanied Fox News correspondent Benjamin Hall and veteran videographer Pierre Zakrzewski on a reporting trip outside Kyiv, just weeks after Russia’s invasion in March 2022.”
The outlet goes on to report that Kuvshynova and Zakrzewski died from shelling that struck them when they ventured into Kyiv suburbs during the war.
“The three journalists ventured into the Kyiv suburbs during fierce fighting. Kuvshynova and Zakrzewski were killed by Russian shelling; Hall was seriously injured but survived,” NPR reports.
Now, with this lawsuit, Kuvshynova’s parents are trying to claim that Fox engaged in “reckless and negligent conduct” by sending these journalists into this dangerous situation.
The lawsuit
CNN reports that, in the lawsuit, “[Fox is] accused Thursday of being culpable for the fatal incident by engaging in ‘reckless and negligent conduct’ that put the crew in harm’s way.”
The outlet continues, “The network was also accused of launching ‘a campaign of material misrepresentations and omissions to hide its own accountability for the disaster and shift blame’ to then-security contractor Shane Thomson, who allegedly warned against the crew entering the dangerous zone near Kyiv where they were killed.”
The lawsuit, for example, states:
The actual circumstances of Sasha’s death — which contradict the official accounts given by Fox, Ben Hall, and Harper Collins — were only uncovered through investigation by their counsel almost two years later. New information and new contradictions are still being uncovered to this day.
Kuvshynova’s parents have released a statement on the matter through their attorney, Stephen Humphreys.
Humphreys is reported by NPR as saying:
It’s time for Fox to come clean for her, for better or worse, and deal with the consequences. The thing that’s most important for the Kuvshynovas, when they think about their daughter, is that this doesn’t ever happen to anybody else again.
