Paperwork failures by the White House have led to the dismissal of about 200,000 deportation cases.
This is according to a new report from Syracuse University’s Transactional Records Access Clearinghouse (TRAC).
“Approximately 200,000 deportation cases have been thrown out by Immigration Judges since the start of the Biden administration because the Department of Homeland Security (DHS) hadn’t filed the required Notice to Appear (NTA) with the Court by the time of the scheduled hearing,” the authors write.
They add, “Without a proper filing, the Court lacks jurisdiction to hear the case, and the immigrants, often asylum seekers, lack a way to move their case forward.”
The “why?”
The big question, of course, is why there have been so many paperwork failures here.
The answer is unclear. TRAC, in its report, writes that there was an “almost total lack of transparency on where and why these DHS failures occurred.”
Another big question is what happens to these cases once the courts dismiss them.
The answer to this question is also unclear. TRAC reports, “Equally troubling is the lack of solid information on what happened to these many immigrants when DHS never rectified its failure by reissuing and filing new NTAs to restart their Court cases.”
The Biden administration has not commented on TRAC’s report.
Biden’s illegal immigration problem
America has seen record levels of illegal immigration, via the U.S.-Mexico border, under President Joe Biden’s watch.
December 2023, in particular, was one of the worst months on record for illegal immigration, with the U.S. Border Patrol witnessing over 300,00 illegal alien encounters. This number dropped off in January 2024, and the February 2024 numbers, at the time of the writing, have yet to be released.
This is turning into a major reelection issue for Biden, who will be facing off against former President Donald Trump in the upcoming general election. Real Clear Politics has Biden underwater, on average, by 30.8 percentage points on the illegal immigration issue. A Wall Street Journal poll has Biden 37 percentage points underwater on the issue.
Trump, on the other hand, continues to get favorable polling numbers with regard to illegal immigration. Trump is already promising to reverse Biden’s open border policies immediately upon taking office, should Trump defeat Biden in the election and win a second term as the U.S. president.
Biden, in the meantime, has been trying to convince the American people that the Republicans are the reason why the southern border crisis is so bad. But, the polls would clearly suggest that Americans are not buying this.
