The Supreme Court has barred Texas from implementing a state law that was set to take effect Monday and would have allowed state police to arrest immigrants on state, not federal, charges if they illegally enter the United States from Mexico.
The court ruled Monday evening to continue a temporary hold that was initially issued on March 4, two weeks before the law was set to begin.
“Upon further consideration of the application of counsel for the applicants, the response, and the reply filed thereto, it is ordered that the stay issued on March 4, 2024, is hereby extended pending further order of the undersigned or of the Court,” Associate Justice of the Supreme Court Samuel Alito wrote in the order.
The report explains that Texas Gov. Greg Abbott (R) had signed Senate Bill 4 into law in December, which allows state police to arrest illegal aliens on immigration charges. Previously, only federal police could do so.
The new Texas law also allows local judges to order someone in custody to be deported from the U.S.
The Biden administration sued Texas over the law in January, and a judge temporarily blocked the law in February. Now the Supreme Court has added another temporary block. It is still unknown when the Supreme Court will make the final decision on the Texas law.
Abbott responded to the ruling, writing, “Supreme Court temporarily halted enforcement of SB 4 but Texas is still using its authority to arrest illegal immigrants for criminal trespass and other violations of law. We continue building the wall, use NG to erect razor wire barriers to repel migrants & buoys remain in river.”

On Sunday, Abbott posted a video of border wall under construction, and wrote, “Texas’ border wall construction is ongoing in Maverick County. Texas will not back down from our efforts to secure the border.”
